General information on purchases made from Cheesemaking.

The information on this Cheesemaking website www.cheesemaking.com.au has been developed to be accurate at the time of publication. The information provided is on an “as is” basis, and makes no representation as to the accuracy, completeness, currency, or reliability of the information contained. Cheesemaking will not be liable in contract, tort (including negligence) or otherwise to you or the intended recipient for any direct, special, indirect or consequential loss or damage (including loss of profits or loss of data) arising out of or in connection with this website.

By completing the purchase of a product or products from this website, an agreement exists between you and Cheesemaking. Each subsequent order is a new and separate agreement.

If you select to accept the ‘Terms and Conditions’ on this website, you have deemed to have placed an order with Cheesemaking. Cheesemaking reserves the right to accept or reject an order for any reason including without limitation, unavailability of the product; an error in the price, image or product description; or error in your order. Orders are deemed received by Cheesemaking at the time of successful receival of the transmission by Cheesemaking. At this time, you will be unable to cancel, change or seek a refund for the order.

Conditions relating to the purchase and attendance at an Intensive Cheesemaking Courses here referred to as Course or Courses

Course notification: Participants will be notified by email when their payment is received by Cheesemaking. Approximately one week before the Course commences, a letter containing the location, start and finish times, a program and optional reading material will be forwarded to each participant by email.

Privacy: The information contained in this registration helps Cheesemaking to administer and process your enrolment and to send you the event information. Your contact details will not be disclosed to any other organisation.

Cancellation Policy: Written cancellations received in writing at least 30 days prior to the Course start date, will incur a penalty by way of forfeiture of 50% of the advertised course cost as an administration fee. Course cancellation also includes transferring or postponing the Course registration by the participant. Requests in writing for a substitution of the person attending the course may be made at any time, to Cheesemaking, prior to commencement of the Course. Approval of any substitution is at the sole discretion of Cheesemaking.

No fees will be refunded if a Course registration is cancelled by the participant up to and including 30 days before its start date.

Course date and location changes: Cheesemaking reserves the right to cancel and/or reschedule a Course or change the location of a Course.

Course cancellation: If a Course has been cancelled by Cheesemaking and an alternative course date cannot be provided within four weeks of the cancellation notice, then a full refund will be provided. In the event of a Course cancellation, Cheesemaking is not responsible for any costs, damages or expenses incurred by the participant.

Course postponement: If a Course is postponed for any reason, (including due to the sickness of Cheesemaking staff, venue availability, Covid-19 circumstances and travel restrictions) an alternative date will be provided by Cheesemaking. If the alternative date provided by cheesemaking is not suitable for the participant, the participant must notify Cheesemaking within one week of being notified of the alternative date. It is then up to the participant to nominate a future date to attend a Course. There is no expiry date on attending a future Course. If no notification has been received by Cheesemaking, the participant has been deemed to accept the new date and the Cancellation policy will apply.

Refunds are not available to course participants if a Course is postponed. In the event of a Course postponement, Cheesemaking is not responsible for any costs, damages or expenses incurred by the participant.

Right to refuse: Cheesemaking reserves the right to refuse a participant entry to a Course if the Course instructor feels they are behaving in a manner that is not conducive to the satisfaction of Cheesemaking or other participants, they are disruptive, ill, intoxicated or may cause harm to themselves or anyone else attending the scheduled class. Refunds are not provided if a participant is refused entry to a Course.

Damage/loss of personal property: Cheesemaking will take all necessary care but accepts no responsibility for the damage to or loss of merchandise left in the venue before, during or after the Course. Cheesemaking is not responsible for the loss or damage of personal items in any form.

Liability waiver and release: When participating in a Cheesemaking Course, the participant releases, indemnifies and excludes Cheesemaking and Graham Redhead and his employees and assistants (paid or unpaid) from any and all liability of any kind for any damage or injury incurred while attending or visiting a cheesemaking event. The participant understands these terms and conditions and accepts the inherent risks of a kitchen environment before they make a full payment for a course. A Liability waiver and release (see below) will be provided to all potential participants before they complete their registration. It is a condition of registration that you agree to sign and date the Liability and Waiver Release before the event commences. Refusal to sign the Liability and Waiver Release will be considered a cancellation of registration and the Cancellation Policy will then apply.

Conditions relating to the purchase of Cheesemaking Equipment.

Product Availability: Cheesemaking will endeavour to ensure the products you have ordered are available for delivery. Where a product is not available, Cheesemaking will notify you within one week of placing that order and will provide an option to supply the product when it becomes available, provide an alternative product or to refund in full all amounts paid in respect that portion of the order relating to the unavailable product.

Payment for Products: The default payment method for products is by Stripe Payment Portal. When you make the purchase, you will be transferred to an external site operated by Stripe. You agree that Stripe is responsible for processing and the security of your payment, and you hereby release Cheesemaking from any liability in relation to such payment. Please refer to the Stripe terms of use for conditions applying to payment processing services.

Responsibility of Cheesemaking and the Purchaser

Cheesemaking has fulfilled its obligation to deliver when the goods have passed over the Australia Post. This means that the purchaser has to bear all costs and risks to loss of, or damage to the goods from that point.

For purchases that require postage or courier services outside of Australia’s border, the purchaser is responsible for clearing the goods for export from Australia. The purchaser is also responsible for complying with any import requirements of the destination country, including any Biosecurity, Import and the payment of any Customs Duties. The purchaser must bear all costs and risks of loss or damage to the goods from when the goods have passed over to Australia Post or the courier used by Cheesemaking.

Postage and Delivery – Perishable and non-perishable products

Due to regional locations and logistic delays, it may take longer than ‘next day delivery’ for the perishable items. Several days without refrigeration will not have a detrimental effect on either the frozen or refrigerated items.

Cheesemaking does not accept any responsibility for delays in delivery or packages lost in transit if the package has been correctly labelled when it is dispatched. Cheesemaking does not accept responsibility for costs incurred for re-delivery if the package is returned to a different location because it could not be delivered. Please provide clear instructions when placing an order to ensure your equipment has the best chance of being delivered to the correct location.

It is Cheesemaking’s intention is to dispatch all items on the following Monday, Tuesday and Wednesday after your order has been placed. Cheesemaking and or Australia Post will notify you via email within 24 hours of the order being dispatched so that you can choose to make arrangements if you are not home when your package is delivered. All orders are despatched on a Monday, Tuesday or Wednesday. Packages are not sent prior to public holidays to prevent perishable items potentially sitting in a post box unnecessarily.

It is the responsibility of the person placing the order to provide Cheesemaking with the correct address and any delivery instructions that will minimise any delays in getting the package to you. It is strongly suggested that packages are not sent to addresses belonging to units, townhouses or similar complexes due to the complexities that may arise in packages being lost, stolen or misplaced.

Refund Policy: Please choose your items carefully as you are not entitled to a refund if you simply change your mind. You may seek a refund for goods purchased from us if the product is faulty. However, faulty goods must be notified by email to Cheesemaking within 1 week of purchase or within two weeks of the fault occurring. Proof of purchase will be required.

Conditions relating to the purchase of a Cheesemaking Gift Voucher

Cheesemaking gift vouchers should be treated as cash. The unique identifying number provided to you must be input either online or via email to redeem the voucher.

The gift voucher cannot be credited, returned or exchanged for cash.

The voucher may be transferred to another person’s name not provided on the gift voucher provided Cheesemaking is notified by email and approves of the impending transfer.

The voucher must be used in one transaction. A separate voucher or a credit will not be issued for any amounts not redeemed.

Gift vouchers are valid for 18 months from the date of issue, after which time the voucher will be void.

The conditions relating to the purchase and attendance at an Intensive Cheesemaking Course and or Conditions relating to the purchase of Cheesemaking Equipment apply to all persons receiving the gift voucher.

LIABILITY WAIVER AND RELEASE FOR CHEESEMAKING EVENTS

I, _____________________________________ of ___________________________________________ (“the Releasor”) state that I:

  1. acknowledge receipt of the pre-course notes and Cheesemaking Recipes and Notes from Simple Dairy Solutions Pty Ltd A.B.N. 66 095 232 621 t/as Cheesemaking (“the Releasee”) and the hygiene and safety instructions contained therein.
  2. in consideration of the Releasee accepting my registration and allowing me to participate in this Cheesemaking event I am aware that participation carries with it inherent risks (including but not limited to):
  • working with or near hot water.
  • lifting pots of milk and water up to 20kg in weight

(c)  walking on damp or wet floors.

(d)  working with diluted iodine solutions.

(e)  the consumption of cheeses made at the cheesemaking course

  1. indemnify and agree to hold harmless the Releasee and all of its employees’ agents or servants and release them from any liability or responsibility for accident, damage, injury or illness that may occur to me as a result of participating in a cheesemaking event conducted by the Releasee.
  2. agree to immediately inform the Releasee if I am allergic to any of the ingredients or to iodine or if I feel unwell and will refuse to participate any further in the cheesemaking event.
  3. hereby assume full responsibility for any risks of and release and indemnify the Releasee from all claims, demands, actions, and causes of action and/or litigation for any economic or non-economic loss due to bodily injury or death sustained by me or a third party as a result of working with, storing or consuming any of the cheeses made by me during the cheesemaking event.
  4. understand that any insurance cover affected for participants may not cover me for any or all injury, loss or damage sustained by me.
  5. I give permission/do not give permission for Cheesemaking to place pictures taken at this Cheesemaking event onto the Cheesemaking Website and Social Media Platforms
  6. warrant that I:

(a)  have read and understood this document and the rights that I am giving up by signing it.

(b)  am aware that I should seek independent legal advice before signing this document and have chosen not to seek such advice.

(c)  am over the age of eighteen (18) and have signed this document freely and voluntarily without any inducement or coercion by the Releasee/am accompanied by a parent or legal guardian who has signed this document on my behalf; and

(d)  acknowledge that the Releasee is relying on the representations made by me in this document.

Making cheese prior to the course is not essential but it is very strongly recommended. I have found that over many years of providing cheesemaking courses, having some basic cheesemaking experience before you get to the course is an enormous help with taking in the information provided at the course.
